Private Encounter Terms and Conditions

These Terms and Conditions ("Agreement") govern the booking, participation, and conduct of private wildlife encounters provided by Animals Anonymous ("we," "our," "us"). By booking or participating in a wildlife encounter or purchasing a voucher through our website, you ("Guest," "you," or "your") agree to the following terms and conditions. Please read them carefully.
1. Booking and Reservations
1.1 Reservation Requirement
All private wildlife encounters must be booked in advance via email. Reservations are subject to availability.
1.2 Group Size and Duration
Each wildlife encounter is for up to 5 participants maximum. Encounters typically last for 60 minutes, unless otherwise stated.
1.3 Presence of NDIS Participants
Depending on the day, there may be NDIS participants from our Training Pathways Program present during your encounter, accompanied by their designated staff member. We appreciate your understanding and cooperation in maintaining a respectful environment for all participants.
1.4 Booking Modifications and Cancellations
Changes to your booking (e.g., date, time, number of participants) must be requested at least 48 hours in advance.
2. Voucher Terms
2.1 Voucher Purchase and Use
All vouchers for private wildlife encounters must be purchased directly through our official website at www.animalsanonymous.com.au. Vouchers are non-transferable and non-refundable. Vouchers cannot be exchanged for cash or credit.
2.2 Voucher Validity
Vouchers purchased through our website are valid for 12 months from the date of purchase, unless otherwise specified.
2.3 Expiry
Vouchers must be redeemed within the 12-month validity period. After the expiration date, vouchers are no longer valid, and any unused value will be forfeited.
2.4 Voucher Extensions
Voucher extensions may be granted at the sole discretion of Animals Anonymous under certain circumstances, but this is not guaranteed. Requests for extensions must be submitted before the voucher expires.
3. Participation Requirements
3.1 Age Restrictions
Children under 16 must be accompanied by an adult at all times.
3.2 Health and Safety
Guests must disclose any health conditions or physical limitations that may affect their ability to participate in the encounter. We reserve the right to refuse participation to anyone who we deem to be unfit for the activity for health or safety reasons.
3.3 Respectful Behaviour
Guests must adhere to all safety guidelines and instructions provided by our guides and staff. Any behaviour deemed disruptive, disrespectful, or unsafe may result in immediate termination of the encounter without refund.
3.4 Clothing
Please wear enclosed footwear.
3.5 Food and Drink
Food is prohibited on site. We recommend bringing plenty of water to stay hydrated.
4. Wildlife Encounter Guidelines
4.1 Wildlife Interaction
Guests agree to respect all wildlife and follow the guidelines set by our staff. We do not guarantee specific wildlife sightings or interactions, as animals may behave unpredictably and may not be present at the time of the encounter.
4.2 Photographs and Recordings
Guests are welcome to take photographs and videos during the encounter for personal use. However, the use of drones or any equipment that could disturb wildlife is prohibited unless otherwise stated. By participating, you consent to us using photos or videos taken during the encounter for promotional purposes, unless you opt out in writing.
4.3 Prohibited Actions
The following actions are strictly prohibited during the wildlife encounter:
Feeding or attempting to interact with wildlife inappropriately
Littering or leaving waste behind
Use of harmful substances or materials that may disturb the animals
Touching or attempting to touch wildlife, unless expressly allowed by staff
5. Health and Safety
5.1 Risk Acknowledgment
Participation in wildlife encounters involves inherent risks, including the risk of injury or harm caused by wildlife. By booking the encounter, you acknowledge and accept these risks and agree to hold Animals Anonymous harmless from any liability arising from your participation, except where such injury or harm is caused by our negligence or misconduct.
6. Liability and Indemnification
6.1 Limitation of Liability
To the maximum extent permitted by law, including under the Australian Consumer Law, Animals Anonymous is not liable for any personal injury, death, loss, or damage to property resulting from the wildlife encounter, except where caused by gross negligence or wilful misconduct on our part.
6.2 Indemnity
You agree to indemnify, defend, and hold harmless Animals Anonymous, its employees, agents, and affiliates from any and all claims, demands, losses, damages, liabilities, or expenses (including legal fees) arising out of your participation in the wildlife encounter, including any breach of these Terms and Conditions.
7. Force Majeure
We are not liable for failure or delay in performing our obligations under this Agreement if such failure is due to circumstances beyond our control, including, but not limited to, extreme weather, natural disasters, or unforeseen wildlife behaviour.
8. Privacy and Data Protection
We collect personal data as part of the booking process. By booking an encounter, you consent to the collection and use of your personal information. We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth).
9. Amendments to the Terms
Animals Anonymous reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be communicated to guests prior to their scheduled encounter. Continued participation in the encounter after such modifications constitutes acceptance of the updated Terms.
